Terms of Service

The Elevate Platform is proprietary software owned and operated by Elevate Real Estate Team LLC, a New Jersey limited liability company (8 Kimble Ln, Sparta, NJ 07871). "Coldwell Banker Realty" is the affiliated brokerage brand under which the team's agents are licensed and is a separate entity from the software owner.

These Terms govern your use of the Elevate Platform ("Elevate," "the Platform"). By signing in, you agree to these Terms. Elevate is a private business tool provided by Elevate Real Estate Team LLC to authorized members of the Elevate Real Estate Team.

1. Eligibility & accounts

Access is limited to authorized Elevate Real Estate Team members and staff. You are responsible for your account, keeping your credentials secure, and all activity under your login. Accounts are not transferable.

2. Acceptable use

Use Elevate only for legitimate real-estate business on behalf of the team.
Do not share access with unauthorized people or scrape, resell, or redistribute platform data.
Do not upload unlawful content or use the platform to send spam or content that violates CAN-SPAM, TCPA, or other marketing laws.
Comply with all MLS rules, IDX/VOW display policies, fair-housing laws, and your brokerage's policies.

3. MLS & listing data

Listing data is provided under the rules of the applicable MLS and may only be used as those rules permit. Listing content remains the property of the listing brokers and/or the MLS. Do not use MLS data for any purpose prohibited by the MLS.

4. Client & confidential information

You are responsible for handling client and contact information lawfully and confidentially. Information about the team's business, pipeline, and clients is confidential and may not be disclosed outside the team without authorization.

5. Third-party integrations

When you connect a third-party service (e.g., Follow Up Boss, Microsoft Outlook/365, Meta/Facebook & Instagram, Google, Zillow), your use of that service is also governed by that provider's terms. We are not responsible for third-party services.

6. Intellectual property

The Elevate Platform, its software, and its design are the exclusive property of Elevate Real Estate Team LLC. The "Coldwell Banker" and related brokerage marks are owned by their respective owners and are used under the team's brokerage affiliation. You may not copy, reverse-engineer, resell, or reuse the platform or its branding outside authorized team use.

7. Marketing materials

Flyers, social posts, emails, and other materials you generate are tools to assist your business. You are responsible for ensuring anything you publish or send is accurate, compliant, and properly disclosed (including required brokerage and license info).

8. Disclaimers

Elevate is provided "as is." Figures, reports, and AI-generated content are for convenience and may contain errors; verify important data (e.g., pricing, financials, compliance numbers) against the source of record before relying on it.

9. Suspension & termination

Access may be suspended or terminated if you leave the team or violate these Terms. On termination, your right to use the platform ends.

10. Text message (SMS) alerts

Elevate offers optional text alerts to agents and staff of Elevate Real Estate Team LLC. They are used only for operational notices about your own work — a lead assigned to you, an open house needing a host, an administrator updating one of your requests, or an onboarding task becoming available. We do not send marketing or promotional texts, and we do not text clients or leads.

Text alerts are off by default. You turn them on yourself under Profile → Notifications by ticking the TEXT box beside each alert type you want. Ticking a box is your consent, and it applies only to that alert type. Consent is not a condition of employment or of using the platform.

Reply STOP to any message to end all texts immediately, or untick the boxes in your profile. Reply HELP for assistance. Message and data rates may apply, and message frequency varies with your activity. Texts are sent to the number on your profile — keeping it current is your responsibility.

No mobile information will be sold or shared with third parties for promotional or marketing purposes. See our Privacy Policy for how this data is handled.

11. Changes

We may update these Terms; continued use after changes means you accept them. The "Last updated" date reflects the current version.
